How Virginia calculates your weekly check

While your doctor keeps you off work, Virginia pays temporary total disability (TTD) benefits of 66 2/3% of your average weekly wage. The result is limited to a weekly maximum and minimum that Virginia resets on a fixed schedule. Your limits are the ones in effect on your date of injury.

  • Maximum: $1,507.01 a week (injuries from July 1, 2026 to June 30, 2027).
  • Minimum: $376.75 a week, or your actual wage if it is lower.
  • Previous maximum: $1,463.10 for injuries July 1, 2025 to June 30, 2026.
  • When the cap applies: an average weekly wage above $2,260.52 reaches the maximum.

The maximum is 100% and the minimum 25% of the state average weekly wage. Benefits can never exceed your own average weekly wage.

An injury from January 1 to June 30, 2026 uses the earlier limits: $1,463.10 maximum and $365.78 minimum.

Waiting period

No pay for the first 7 days. If incapacity lasts more than three weeks, those days are paid back. The waiting period applies to wage benefits only; medical treatment is covered from the first day.

How long benefits last

Total compensation is limited to 500 weeks, except permanent and total incapacity, which is paid for life.

Permanent disability and settlements

Virginia pays permanent partial loss only for the body parts in Va. Code 65.2-503(B), at 66 2/3% of your wage for the rating percentage times the listed weeks, within the same weekly maximum and minimum. The back, neck and body as a whole are not on the schedule.

Permanent partial benefits are paid after temporary total benefits end, and you can receive them while working once you reach maximum medical improvement.

Disfigurement is paid for up to 60 weeks.

Example: A 10% rating of the hand is 15 weeks. At a $1,000 weekly wage the rate is $666.67 a week, for a statutory value of about $10,000.

The statutory award is what the law provides for the rating. A settlement is negotiated and can be higher or lower, for example to close out future medical care. It must usually be approved by the state agency or a judge.
